A commentary on the recent Marriage Referendum by Dr Fergus Ryan of the Department of Law has been published in the Italian comparative constitutional law journal Diritto Pubblico Comparato ed Europeo, DPCE Online

The commentary reflects on the constitutional aspects of the referendum, detailing the background to the vote and the implications of the outcome for Irish family law. The commentary examines, in particular, the merits and drawbacks of achieving marriage equality by popular referendum. It also highlights concerns that the referendum, while implicitly endorsing a more diverse view of family life, nonetheless maintains and to some extent entrenches the privileged position of marriage.
