Hubert Smekal is the leading author of the research article “Through selective activism towards greater resilience: the Czech Constitutional Court’s interventions into high politics in the age of populism” just published in The International Journal of Human Rights. Hubert Smekal, Jaroslav Benák and Ladislav Vyhnánek argue that the Czech Constitutional Court has not fallen victim to a Hungarian or Polish-style populist capture due to its institutional design, a reservoir of good public reputation and its selective activism. The Court mostly stayed away from cultural wars and instead focused on keeping political competition fair, protecting a proportional election system that prevents the accumulation of power.
