Dr Aisling McMahon was invited to deliver a research seminar at the Centre for Ethics and Law in the Life Sciences (CELLS) Durham University on 30th October 2019. Dr McMahon delivered a paper entitled ‘Biotechnology and Patent Licensing for ‘Ethical’ Use’ which considered the role of licensing conditions on patents related to CRISPR gene editing technologies, and argued in favour of a reconceptualization of the role for ethical conditions on patent licensing within a broader regulatory framework for advanced biotechnologies. This paper is developed from Dr McMahon’s current Irish Research Council funded project ‘Patents and Biotechnology: Licensing as Ethical Governance?’. Dr McMahon writes primarily on medical law and the relationship between health and patent law. Her recent work in the patent field includes a 2017 article in the International Review of Intellectual Property and Competition Law examining the role of the morality provisions in the planned European unitary patent system; and a 2019 article in the European Intellectual Property Review (pre-print version available here) examining the marginalisation of ethical issues within gene patenting based on research conducted under a British Academy funded project on the topic. Dr McMahon is a lecturer in Maynooth University Department of Law where her teaching includes a module on Contemporary Issues in Medicine and the Law and a new module on Patents, Health and Biotechnologies.
