Dr. Ian Marder publishes article on the international framework for restorative justice

In November 2020, Dr. Ian Marder published a new article analysing a series of recent developments in international law and policy relating to restorative justice. In the paper, he notes that the last three years have seen legal instruments and publications from the United Nations, European Union, Council of Europe and Organization of American States that reflect a growing consensus on the need to ensure that restorative justice is available for criminal cases and other conflicts in criminal justice. The Council of Europe took this furthest, proposing a cultural shift that transcends the restorative versus criminal justice dichotomy by mainstreaming restorative principles throughout the criminal justice process and in the internal operations of criminal justice institutions. The paper considers the implications of these developments for restorative justice service accessibility and cultural change in criminal justice institutions.
